Albright Holds Off On Roofing Patent Case For PTAB Review

By Tiffany Hu (October 6, 2021, 9:20 p.m. EDT) — Texas Western District Judge Alan D. Albright pauses a patent case over roofing systems and says there is a “high probability” that the patent in question will be dropped the Patent Trial and Appeal Board before the case goes to trial.

In an injunction issued on Tuesday, Judge Albright denied IKO Industries Ltd.’s request. granted to suspend a patent lawsuit against the company, filed by Kirsch Research and Development LLC, over the PTAB’s interpartes review of the same patent, which was separately challenged by Owens Corning.
